GENERAL EXPLANATION REGARDING REQUESTS FOR INFORMATION ON PERSONAL DATA PURSUANT TO LAW NO. 6698
1. INFORMATION ON SUBMITTING A REQUEST
Article 11 of the Personal Data Protection Act No. 6698 sets out the rights of the data subject. Under the Act, the data subject is referred to as the ‘data subject’, and the right to make certain requests regarding the processing of their data is provided for. In accordance with this article, the data subject’s rights to make requests are as follows:
To find out whether personal data has been processed,
To request information regarding the processing of personal data if it has been processed,
To find out the purpose of the processing of personal data and whether it is being used in accordance with that purpose,
To know the third parties to whom personal data has been transferred, whether within or outside the country,
To request the rectification of personal data if it has been processed incompletely or incorrectly,
To request the erasure or destruction of personal data in accordance with the conditions set out in Article 7 of the Act, entitled ‘Erasure, Destruction or Anonymisation of Personal Data’,
To request that third parties to whom personal data has been transferred be informed that incomplete or incorrectly processed data has been rectified, or that the data has been erased or destroyed at the data subject’s request,
To object to a decision being made solely through the automated processing of data that adversely affects the data subject,
To request compensation for any damage suffered as a result of the unlawful processing of personal data,
Applications must be made by the data subject themselves. Applications cannot be made regarding the personal data of another person. Should the FOUNDATION have doubts regarding the applicant’s identity, it may request further information from the data subject for verification purposes. Should the FOUNDATION determine that a request for information has been made on behalf of another person, the FOUNDATION reserves the right to take any legal action and make any claims.
2. INFORMATION ON THE APPLICATION PROCEDURE
You may submit requests regarding the rights outlined above to the FOUNDATION, acting in its capacity as the data controller, in writing or via a registered electronic mail (KEP) address, a secure electronic signature, a mobile signature, or the email address previously notified to the data controller by the data subject and registered in the data controller’s system. For written applications, you may submit your request by printing out the ‘Information Request Form’, which you can download by clicking on the link below. When sending this form to our foundation, it must be placed in an envelope and marked ‘Request for Information Regarding Personal Data’. The application form may be sent to us:
In person by the data subject;
By registered post with return receipt;
Through a notary public;

3. INFORMATION REGARDING THE DATA SUBJECT MAKING THE REQUEST
The information request you have submitted to us must include, in full: your first name, surname and, if the application is in writing, your signature; your Turkish ID number; for foreign nationals, your nationality, passport number or, if applicable, identity number; your residential or business address for service of notice; your email address for notification, if applicable; your telephone and fax numbers; and the subject of the request. Should any of the aforementioned details be missing, your information requests cannot be processed by the FOUNDATION. The FOUNDATION accepts no liability for failure to respond to a request where the information provided is incorrect or incomplete. Furthermore, we kindly request that any relevant information and documents be attached to your application.
